1. About Apartments UA

Apartments UA is an online platform for searching and booking short‑term accommodation in Ukraine.

On Apartments UA, property owners and management companies can publish information about available accommodation, while users can search for suitable options, send requests, and make bookings.

Apartments UA is integrated with PMS.Rent. The integration provides synchronization of bookings, property management, and online payment processing using the technical infrastructure of PMS.Rent.

Apartments UA is an affiliated agent of PMS.Rent in Ukraine and operates within the scope of authority granted by PMS.Rent. This status refers to the interaction between Apartments UA and PMS.Rent and does not imply that Apartments UA is the owner, landlord, or management company of each property listed on Apartments UA.

Unless otherwise explicitly stated in the terms of a specific booking, Apartments UA provides a service that facilitates interaction between users and property owners or management companies. The property owner or management company is responsible for the accommodation, the accuracy of the information provided, its availability, check‑in, compliance with house rules, and fulfillment of obligations to the guest.

2. Acceptance of these Terms

These Terms govern the use of the Site and its functions.

By browsing the Site, the user may view the information published on it. By using functions that require registration, submission of personal data, submitting a request, making a booking or making a payment, the user confirms that they have read these Terms and agree to comply with them.

Additional documents apply to specific services:

These documents form part of the rules governing the use of the relevant Site functions. If there is a conflict between these Terms and the specific rules applicable to a particular service, the specific rules shall apply to that service.

3. User Account and User Data

To access certain Site functions, a user may create an account or provide information through a request form.

The user must:

  • provide accurate and up-to-date information;
  • not use another person's data or account without permission;
  • keep their access credentials secure;
  • promptly report any suspected unauthorized access;
  • not share access to their account with other persons unless otherwise provided by the functionality of the Site.

The user is responsible for actions performed using their account unless they can demonstrate that the account was accessed and used through no fault of their own.

Personal data is processed in accordance with the Privacy Policy. The use of cookies is governed by the Cookie Policy.

4. Property Listings

Information about real estate properties, including photographs, descriptions, location, price, availability, amenities and house rules, may be provided by property owners, management companies or other partners.

Apartments UA seeks to keep information on the Site up to date, but does not guarantee that every listing is always complete, accurate or current. The availability of the property and the final accommodation terms should be verified before confirming a booking.

The property owner or management company is solely responsible for:

  • having the right to list the property and offer it for short-term rental;
  • the accuracy of the information contained in the listing;
  • the property's conformity with its description and photographs;
  • the accuracy of the price and availability information;
  • the ability to provide check-in on the specified dates;
  • compliance with applicable laws;
  • fulfillment of obligations towards the user.

Apartments UA may correct, temporarily hide or remove listings if they contain inaccurate information, violate these Terms, the rights of third parties or applicable legal requirements.

5. Requests and Bookings

The user may submit a request or make a booking using the methods provided on the Site.

Submitting a request does not always mean that the booking is automatically confirmed. A booking is considered confirmed after the user receives the relevant notification or after a confirmed status appears in the applicable system.

Before confirmation:

  • the property may be unavailable;
  • the terms or price may require clarification;
  • the request may be rejected by the property owner, management company or system;
  • the user may be asked to provide additional information.

The terms of a specific booking, including dates, number of guests, price, payment procedure, cancellation rules and other restrictions, are provided to the user before completion of the booking or in the booking confirmation.

The detailed booking procedure is set out in the Booking Rules.

6. Payment

If online payment is available for the selected property, the payment may be processed through a payment provider or the technical infrastructure of PMS.Rent.

Before the transaction is confirmed, the user must receive information about the payment amount and applicable terms. Depending on the specific property and payment method, the amount may include accommodation costs, fees, taxes, a security deposit or other applicable charges.

Apartments UA does not store the user's payment details unless expressly stated otherwise in the relevant form or payment service documentation. Payment processing may be carried out by a third-party payment provider in accordance with its own rules.

The procedure for cancelling a booking, receiving refunds and applying any deductions is determined by the Cancellation Policy and the terms of the specific booking.

7. Check-in, Check-out and House Rules

The procedure for accessing the property, check-in and check-out times, key handover arrangements and other organizational matters are governed by the Check-in and Check-out Information page.

The user must comply with the House Rules, the terms applicable to the specific property and the lawful requirements of the property owner or management company.

The user must not:

  • use the property for unlawful purposes;
  • accommodate persons who are not included in the booking if this is prohibited by the applicable terms;
  • transfer the right of occupancy to third parties without permission;
  • violate quiet hours or other house rules;
  • damage property or equipment;
  • create a safety risk to people, the property or neighbors;
  • use the property in a manner inconsistent with its intended purpose.

The user may be liable for damage caused by the user, invited persons or persons to whom the user has given access to the property, to the extent provided by law and the terms of the specific booking.

8. Cancellation and Changes to a Booking

The possibility of cancelling, changing dates, rescheduling a booking and receiving a refund depends on the terms of the specific property and the selected rate.

The user must review the Cancellation Policy before completing a booking.

If the property owner or management company cancels a confirmed booking or is unable to provide the property, the procedure for further action is determined by the booking terms and applicable refund rules.

9. User Obligations When Using the Site

When using the Site, the user agrees to:

  • comply with applicable laws and these Terms;
  • provide accurate information;
  • use the Site only for lawful purposes;
  • not attempt to gain unauthorized access to the Site, user accounts or other users' data;
  • not introduce malicious code or create excessive load on the infrastructure;
  • not circumvent technical restrictions or security measures;
  • not use the Site for fraud, spam or mass messaging;
  • not publish materials that infringe the rights of third parties;
  • not impersonate another person, a property owner, an Apartments UA representative or a partner.

The use of bots, crawlers and other automated tools is permitted only for lawful purposes, provided that they do not circumvent Site restrictions, violate access rules or create excessive load on the infrastructure.

10. User Content

The user may post messages, reviews, photographs, descriptions and other materials on the Site if the relevant functionality is available.

The user confirms that:

  • they have the necessary rights to the material being posted;
  • posting the material does not violate the law or the rights of third parties;
  • the information contained in the material is materially accurate;
  • the material does not contain malicious code, spam, insults, threats, discrimination or unlawful advertising.

The user retains the rights to content they have created. By posting content on the Site, the user grants Apartments UA a non-exclusive right to store, reproduce, display and use it to the extent necessary for the operation of the Site, publication of a listing, processing of a request, provision of the relevant service and its promotion, where such functionality is provided by the Site.

Apartments UA may remove, hide or restrict access to material if it violates these Terms, applicable legal requirements, the rights of third parties or the rules of the relevant section of the Site.

11. Intellectual Property

The rights to the software, design, structure, logos, trademarks and proprietary materials of the Site belong to Apartments UA or the respective rights holders.

The rights to listings, photographs, descriptions and other materials posted by property owners, management companies, users or partners belong to the respective rights holders.

Without the prior permission of the rights holder, it is prohibited to copy, distribute, modify, sell or otherwise use materials from the Site, except where permitted by law or where necessary for personal use in connection with using the Site.

12. Limitation of Liability

Apartments UA seeks to ensure stable operation of the Site and the accuracy of the information published on it, but does not guarantee that:

  • the Site will be continuously available and free of technical errors;
  • all listings will be complete, accurate and up to date;
  • every property will be available at any given time;
  • the Site will be completely protected from technical failures, malicious code or actions of third parties;
  • the results of using the Site will meet the user's individual expectations.

Apartments UA is not responsible for the acts or omissions of property owners, management companies, guests, payment providers, communications providers or other third parties, unless otherwise expressly provided by law or a separate agreement.

The limitations of liability do not apply in cases where such liability cannot be excluded or limited under applicable law.

Nothing in these Terms deprives the user of mandatory rights granted by law or limits liability for intentional harm, fraud or other cases where limitation of liability is prohibited by law.

13. Suspension and Termination of Access

Apartments UA may temporarily restrict or terminate access to the Site, an account or a specific function if:

  • the user violates these Terms;
  • inaccurate information has been provided;
  • there are signs of fraud or abuse;
  • the use creates a security risk to the Site or other persons;
  • this is required by law or requested by a competent authority;
  • the function is temporarily unavailable for technical or organizational reasons.

Where possible, the user will be notified of the reason for the restriction. Notification may not be provided if it creates a security risk, interferes with an investigation of a violation or is prohibited by law.

Restriction of access to the Site does not cancel obligations that arose before such restriction, unless otherwise provided by the terms of the specific booking or by law.

14. Technical Maintenance and Site Availability

The Site and individual functions may be temporarily unavailable due to maintenance, updates, malfunctions, actions of service providers, communication failures or other circumstances.

We may modify, suspend or discontinue individual Site functions. If such a change affects an already confirmed booking, the terms of the relevant booking and the specific service rules shall apply.

15. Third-Party Websites and Services

The Site may contain links, integrations or materials from third-party websites and services. We do not control their content, availability or data processing practices.

The use of a third-party service may be governed by its own terms and privacy policy. Before transferring data or making a payment through a third-party service, the user should review its rules.

It is prohibited to place links to the Site in a manner that creates a false impression among users of a partnership, endorsement or other relationship with Apartments UA.

16. Communications and Electronic Interaction

The user agrees to receive communications necessary for processing a request, confirming, changing or cancelling a booking, as well as for ensuring the security of the user's account.

Such communications are not marketing communications. Separate consent to receive marketing communications is governed by the Privacy Policy and is provided where required.

17. Changes to these Terms

We may change these Terms when the Site, its functions, the manner in which services are provided or legal requirements change.

The new version is published on this page. For an already completed booking, the terms in effect at the time the booking was confirmed shall apply, unless otherwise required by law or agreed by the parties.

18. Applicable Law and Disputes

The use of the Site and the relationships governed by these Terms are subject to the law determined taking into account the location of the relevant party, the nature of the service and the mandatory rules applicable to the specific situation.

Before going to court, the parties seek to resolve the dispute by contacting the support channel available on the Site and exchanging the information necessary to address the disputed matter.

This section does not restrict the user's right to use mandatory remedies available under applicable law.
